1. General Information
These Terms and Conditions govern the use of www.smrtstudio.ro, operated by Smart Studio Production, based in the United Kingdom. By accessing and using this website, you agree to the terms and conditions set forth below.
2. Services Provided
Smart Studio Production offers professional photography services for events (weddings, christenings, parties, etc.) and sells digital photos securely through its online platform. The photographer’s attendance at the event may be free or paid, depending on the type, location, duration, and nature of the event, while the photos can later be purchased individually through the website.
3. Copyright
All photos created by Smart Studio Production are protected by copyright law. Clients may download, use, and share purchased photos for personal, non‑commercial use only. Any commercial use requires written permission from Smart Studio Production.
4. Private Galleries and Access Protection
After each event, photos are uploaded to a private online gallery, accessible only to individuals who receive a password from the event organizers. Each gallery is password‑protected to ensure the privacy of the content. Smart Studio is not responsible for unauthorized password sharing by users.
5. Photo Availability and Content Deletion
Photos remain available for 6 months from the date of publication. After this period, all files are automatically and permanently deleted from Smart Studio’s archive with no recovery option. It is the user’s responsibility to download or purchase desired photos within this timeframe.
6. Pricing and Commercial Conditions
Photo prices may vary depending on the type of event, location, season, duration, and workload, as determined by Smart Studio Production. All prices are set solely by the provider and may change without prior notice; however, the price displayed on the website at the time of purchase is final. Any applicable processing fees (Stripe, PayPal, etc.) are included or displayed separately when applicable.
7. Purchase Process
Photos can be purchased individually, directly from the website, through the Stripe platform. After payment confirmation, the digital file becomes immediately available for download. All transactions are processed securely through encrypted connections.
8. Refund Policy
As these are digital products, purchased photos cannot be returned or refunded. In exceptional cases (technical errors, duplicate payments), customers may contact Smart Studio at rby87uk@gmail.com for assistance.
9. Data Protection
Smart Studio Production complies with the GDPR regarding the protection of personal data. User data (name, email, payment details) is used solely for order processing and is not shared with third parties, except authorized payment processors (Stripe, Wfolio). For details, see our Privacy Policy.
10. Limitation of Liability
Smart Studio Production is not liable for temporary service interruptions, password loss, or unauthorized access caused by users. We reserve the right to update, modify, or suspend website features without prior notice.
11. Right to Image & Deletion Request
Individuals appearing in photos on the website or within private galleries may request the removal of any image featuring them if they do not wish their likeness to be available online. Requests can be submitted to rby87uk@gmail.com, and Smart Studio Production will process them within 10 business days. Removal does not affect files already purchased by other users prior to the request.
12. Promotional Use
Smart Studio Production may use a limited selection of photos for portfolio and promotional purposes (website, social media) only with the verbal or written consent of the organizers. Any refusal must be communicated in writing.
13. Force Majeure
Smart Studio Production shall not be held liable for failure to perform obligations due to force majeure (illness, accidents, extreme weather, technical failures, legal restrictions, etc.). In such cases, a reasonable alternative or rescheduling will be proposed where possible.
14. Post‑Delivery Use
Smart Studio Production is not responsible for comments, sharing, or unauthorized uses of photos by third parties after delivery or purchase. After delivery, responsibility for image use lies with the buyer.
15. Price & Policy Changes
We reserve the right to change prices and sales policies without prior notice; changes do not apply retroactively to completed orders.
